Copyright and plagiarism question?

I want to use an existing song to write a new one that is a little different and from that write a movie script. What are the parameters to keep me from committing plagiarism?

Um, whatever you do, DON'T GET CAUGHT! If you do get caught, say it was AN INNOCENT BYSTANDERs FAULT
As long as you give public credit to the originator it is not plagiarism. It may, however, be a violation of the creator's copyright. You need to get permission from the copyright holder.
If the new song you write based on another song allows the other song to be recognized, whether by its lyrics, melody, percussion, chords, or anything else, that's copyright violation and you won't have a leg to stand on.

If you're capable to writing a new song based on an existing one to which you do not have rights, why not write an original and steer clear of lawsuits?
