The food I supposedly took was food I can't have (medically prohibited). At first the theft was on a day I didn't work. When I said I didn't work that day, company said "Oh, I made a mistake" then he changed the day in question. Company said there was a ( 1 ) witness. I also had a witness (car pooled with co-worker) on the day of question. Applied for unemployment - got it. The company appealed it twice and they lost twice. I was the oldest (age) dietary aide, the heaviest (weight), the shortest (height) and I was the highest paid aide. I went to the CRC - Civil Rights Commission for age discrimanation. The company took over the 45 days allowed to respond. The company says they now have 3 witnesses instead of 1. My witness still works there. Only income coming in is my husband's disability. If I lost the case I would have to pay the company's lawyer, my lawyer and court costs. Company offered $1,000 as a pay off. I took it. Should I have fought the company, anyway?

Kind of pointless now but, I think yes. I understand your position where you were worried about the costs if you lost. Maybe you could have found a lawyer to give a free consulation and an evaluation on your chances.

Yes you should have fought it, it's too late now. Once you've taken a payout from them your case is closed. You also have now 'admitted' that they were right and you were wrong. The only thing I could recommend now is to contact a really good lawyer, and be ready for a fight. You will also need to return the money they gave you but it must be done through the lawyer.
If anyone else is reading this that has been accused of something that did not happen and fired, do not take any kind of financial payout, it is considered accepting the guilt for the situation. You can be denied employment elsewhere if you are accused of theft and fired from a job.
Did your lawyer advise you to accept the offer? It's probably too late to even be worried about it, usually once you accept settlement you have to sign a release. You need to let it go now and get on with your life. Start looking for another job. Go to the Department of vocational rehabilitation in your area and apply for assistance going back to school, they have programs where they will pay you while you are studying.
