i left my home state to visit my mom, i ended up enrolled in colledge and didn't file relocation papers. 3 court dates later i am held in contempt of court and my girls have been taken away and given to their drunk deadbeat biological "sperm donor".
i had a hearing scheduled in april, i faxed in a doctors note to the judge stateing that i could not make the 16 hour trip due to an illness. they went on with the hearing without me and my ex- husband lied his as* off about several things, which i can prove. they came and took my babies 4 days later and that was over a month ago.
i can't afford a lawyer to appeal so i am doing it on my own. the new judge has had the appeal on his desk since 5-11 and still no date has been set yet. i am worried!! the judge told my sherriff that all i had to do was file the appeal and i would get my girls back. he also told my sherriff that he didn't like my ex or his family(long line of criminals and drunks! i was young!)
i need some advice. HELP!!!
Answers:
Normally I only comment on the law in this forum and leave the personal feelings to other.
But imagine a drunk, lying sperm donor or a kidnapping, mother who doesn't think their children are important enough to defend them in court.
Poor children.
I would tell you if you were in my office, to head down the street to the next attorney. I don't believe a word you said.
Sounds sketchy to me.
Where were the kids while you were "accross the state line"?
A Sherriff's authority stops at the county line, The judge's and CPS stop at the state line. If you were in another state.
But, if you were in another state, and your kids were back home, who were they with? The only way you would not know about the hearings were if they were with someone that didnt like you or someone who couldnt find you. If that person was the "dead beat sperm donor" why would you care if he had the kids since you abandoned them to him and ran home to mommy. Its sketchy, could go either way...
You cannot move your children out of state without the fathers permission.
You didn't appear at the court date.a fax won't do it.
No wonder the father got the kids.
Grow up.
