Do I have a legal right to take a bathroom break if I am working 9 hours in New Jersey?


Answers:
According to most state labor laws an 8 hour shift or more should come with a 30 minute lunch break.

Now as far as a bathroom break goes - I can't imagine any company, business or workplace of ANY kind that wouldn't allow bathroom breaks especially for full time employees.

Check out NJ's labor laws and see your Human Resources manager regarding the info you come up with.

I could be wrong, but I believe you should be allowed at least a 30 minute break..I'm not sure how bathroom breaks would come in LEGALLY with a 30 minute break as well.

Wow! If your job hasn't allowed you to even take a bathroom break then you shouldn't be working there.You should probably think about contacting the U.S. Dept of Labor, too or somebody.

What do you mean? Bathroom break is a HUMAN right not a bathroom break. Unless you do it to chat blah blah blah...I'm sure your boss would be pissed off.
Law states that for every 9 hours worked, you get an hour break. Usually two 15 minute breaks, and a half hour break. Which means you should only be working 8 hours a day.
Yes federal law under the fair wage and labor law state that you have to have a min. of one Fifteen minute break for ever 4 hours. with a 30 minute lunch if they had a place were you can eat without, or 1 hour if not.

I don't know specifically about bathroom breaks, but you are entitled to a 30 minute break (off the clock) if your shift is over 5陆 hours and you are entitled to a 10 minute break (on the clock) for every 4 hours. Most employers make a restroom available and it's no issue if you take a couple minutes to use the restroom. But if your bathroom breaks are longer than a couple of minutes then it would probably be viewed the same as taking extra breaks. I'm not sure how this applies if you are in a position where you can not be relieved of duty long enough to use the restroom.

we got breaks every 2 hours still one woman use to just use her chair which was pretty bad since we rotated chairs every fifteen minutes.
